BY CLICKING “BUY NOW”, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND YOU AGREE TO BE BOUND BY, THE FOLLOWING TERMS AND CONDITIONS OF SALE (THESE “TERMS AND CONDITIONS” OR THESE “TERMS”), IN ADDITION TO THE TERMS OF USE (the “TOU” or “TERMS OF USE”) AND THE PRIVACY NOTICE/POLICY (collectively the “WEB STORE TERMS”), WHICH ARE HEREBY INCORPORATED HEREIN BY REFERENCE. Unless the context otherwise requires, all capitalized terms used but not defined herein shall have the meanings set forth in the Terms of Use.
YOU ALSO HEREBY ACKNOWLEDGE AND AGREE THE DIGITAL PRODUCTS OF THIS WEBSITE STORE (THE “WEB STORE”) ARE BEING SOLD TO YOU BY CODA AND THESE TERMS FORM A CONTRACT BETWEEN YOU, ON THE ONE HAND, AND CODA, ON THE OTHER HAND. THESE TERMS AND THE TOU CONTAIN LIMITATIONS OF LIABILITY AND OTHER LEGALLY BINDING CONTRACTUAL TERMS. THESE CLAUSES AFFECT YOUR LEGAL RIGHTS AND REMEDIES, AND YOU SHOULD REVIEW THEM CAREFULLY BEFORE CLICKING “BUY NOW” OR OTHERWISE ACCEPTING THESE TERMS. YOU MAY NOT ORDER OR OBTAIN PRODUCTS OR SERVICES FROM THIS WEB STORE IF YOU (A) DO NOT AGREE TO THESE TERMS, (B) ARE NOT THE OLDER OF (i) AT LEAST 18 YEARS OF AGE OR (ii) LEGAL AGE TO FORM A BINDING CONTRACT WITH US, OR (C) ARE PROHIBITED FROM ACCESSING OR USING THIS WEB STORE OR ANY OF THIS WEB STORE'S CONTENTS, PRODUCTS OR SERVICES BY APPLICABLE LAW.
These Terms composed of Part I (General Terms and Conditions) and Part II (Additional Terms and Conditions) are an integral part of the TOU that apply generally to the use of the Web Store. You should also carefully review our Privacy Notice/Policy before placing an order through this Web Store.
PART I GENERAL TERMS AND CONDITIONS
1. No Monetary Value
You acknowledge and understand that Digital Product has no monetary value and can only be used in the video game (the “Game”) published by Konami Digital Entertainment Co., Ltd. ("KONAMI"), may not be transferred to another person or redeemed for fiat currencies or other things of monetary value, or means of legal tender.
2. Sale Conditions
In respect of your purchases, you confirm that: (i) you are purchasing the Digital Product for your own exclusive and personal consumption; (ii) you shall have no right to rent, lease, lend, sell, redistribute or sublicense the Digital Product you acquire on this Web Store; and (iii) you at all times comply with all applicable laws, rules, regulations and terms and restrictions placed by Coda and/or KONAMI in your purchase and use of the Digital Product.
3. KONAMI ID Account
In order to make transactions or access certain reward schemes, promotions, features or services at the Web Store, we may require you to use your KONAMI ID account registered for the Game. By logging in using your KONAMI ID account, you confirm and agree that you have provided Coda with complete and accurate information about yourself for verification purposes, and that you are responsible for maintaining the confidentiality of your KONAMI ID account, its password, and all activities that occur under your KONAMI ID account. In the event of unauthorized access to your KONAMI ID account at the Web Store, you must notify Coda immediately.
Coda reserves the right at its sole discretion to suspend or terminate your access or use of the Web Store using the KONAMI ID account at any time if:
you attempt to engage in, or indirectly engage in any conduct prohibited under the Web Store Terms;
you breach any clause of the Web Store Terms and, if the breach may be remedied; you fail to do so within thirty (30) days from receiving notice from Coda specifying such breach;
Coda is required to do so by any regulatory authority or law enforcement body;
you have provided us with false or inaccurate information and have failed to provide us with the true or correct information within fifteen (15) days from receiving written notice from Coda requesting such information; or
Coda has determined that the security of your KONAMI ID account has been compromised, or your account has been accessed in an unauthorized manner, and you fail to take action within five (5) days from receiving written notice from Coda specifying the required corrective action.
You are solely responsible for verifying and confirming your KONAMI ID account or any other required information entered during the transaction or when accessing certain reward schemes, promotions, features or services at the Web Store is complete and accurate. By proceeding, you acknowledge that Coda is not liable for errors or refunds due to incorrect KONAMI ID account details or any other information entered by you.
4. Product Description and Delivery
We take every effort to ensure that the product descriptions on the Web Store are as accurate as possible. However, to the extent permitted by applicable law, we do not warrant that such product descriptions are complete or correct.
We do not develop or publish Digital Products offered on the Web Store. KONAMI is the publisher of Digital Products. Other than complying with our Web Store Terms, your use of any Digital Product is subject to KONAMI’s applicable licence terms. KONAMI is solely responsible for delivery of the Digital Product to you.
You understand that while you may “purchase” the Digital Product offered on the Web Store, you do not in fact own or have any intellectual property rights in the Digital Product obtained through the Web Store. Rather, you purchase limited rights to access and use the Digital Product for your exclusive personal consumption. You may not decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Digital Product.
5. Prices and Payment Terms
All prices, discounts, and promotions posted on this Web Store are subject to change without notice.
To make a purchase on the Web Store, you must have a valid and eligible mobile phone account with one of our partner mobile network operators or a valid payment instrument issued or recognized by our payment partners.
You are solely liable for the use of your selected payment instruments in connection with the purchase on this Web Store, and Coda shall have no liability to you or to any third party for any unauthorized use of your payment instruments.
You represent and warrant that (i) the payment information you provide to us is true, correct, and complete, (ii) you are duly authorized to use the chosen payment instrument for the purchase, (iii) you will pay charges incurred by you at the posted prices, including all applicable taxes, duties, currency exchange fees, data charges, and related charges, if any.
If you use a bank transfer as a method of payment, any bank details that you provide will be collected directly by our payment partners. Coda does not collect, store, or process your bank account information. For information on how we process other payment data that you may provide in the course of making a purchase, please refer to our Privacy Notice/Policy.
We reserve the right to reject or decline any transaction for any reason or set limits on transaction types and/or amounts.
6. Disputes and Errors
Disputes: Please contact us if you did not receive the Digital Product, if you believe you have been charged in error or if you have experienced any payment-related issues.
You must not make any false or misleading statements when submitting your complaint, or during the subsequent investigation of a dispute. We will investigate all disputes that are filed with us and will make reasonable efforts to resolve them. However, the ultimate resolution of such disputes shall be at Coda’ sole discretion.
If you have any inquiries related to KONAMI games or in-game items, please use the inquiry form available within the Game.
Error handling: As part of or separate from the dispute handling process, we may determine that a mistake has been made. If we determine that you have been incorrectly charged or overcharged, we will credit your account or otherwise arrange for a refund to rectify the mistake. If we conclude that you were not charged when you ought to have been, or that you have been undercharged, we may collect a payment from you to rectify the mistake accordingly.
Refunds: You acknowledge and understand that all purchases successfully made on the Web Store are final and non-cancellable. No returns will be accepted, and no refunds will be issued unless expressly specified otherwise in these Terms and Conditions. In the event that a refund is made to you after dispute and/or error handling investigation, your payment instrument will be credited in accordance with the terms and time frame set by your bank or payment service provider.
7. Miscellaneous
Limitation of Liability. WITHOUT LIMITATION OF THE TOU, TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL CODA, KONAMI OR ANY OF THEIR RESPECTIVE PARENTS, SUBSIDIARIES, AFFILIATES OR OFFICERS, DIRECTORS, EMPLOYEES OR OTHER REPRESENTATIVES (THE “RELEVANT PARTIES”) BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEB STORE OR THE DIGITAL PRODUCTS, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF ANY RELEVANT PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. IN NO EVENT SHALL ANY OF THE RELEVANT PARTIES’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) HEREUNDER EXCEED THE ACTUAL PRICE PAID BY YOU FOR THE DIGITAL PRODUCT. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE-STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
Release; Waiver. To the greatest extent permitted by the applicable laws and regulations, you hereby agree to release and hold harmless the Relevant Parties from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Web Store and the Digital Products, whether under a theory of contract, tort (including negligence), warranty or other theory. In no event shall you, and you hereby irrevocably waive, any right to sue the Relevant Parties or to seek or obtain injunctive or other equitable relief in connection with the Web Store and any Digital Product.
Severability. Without limitation of the TOU, if any part, term or provision of these Terms and Conditions is held to be illegal, in conflict with any law or otherwise invalid, the remaining portion or portions shall be considered severable and not be affected by such determination, and the rights and obligations of the parties shall be construed and enforced as if these Terms and Conditions did not contain the particular part, term or provisions held to be illegal or invalid.
PART II ADDITIONAL TERMS AND CONDITIONS – COUNTRY-SPECIFIC
European Union (EU)/European Economic Area (EEA)/Switzerland/United Kingdom (UK)
1. Scope of Application
Unless otherwise specified, if you are residing in or located in the EU/EEA, Switzerland, or UK, these provisions (the “EU Provisions”) shall govern your purchase of Digital Product in addition to Part I (General Terms and Conditions) above. In the event of any conflict between these EU Provisions and Part I (General Terms and Conditions) or Web Store Terms, these EU Provisions shall control to the extent necessary to resolve the conflict.
2. Provider of Digital Product
You understand and accept that the Digital Product is being sold to you by Coda Netherlands Holdings B.V., having its registered address at Strawinskylaan 1647, Tower Seven, 16th floor, 1077XX Amsterdam and VAT number NL 862518866B01 (“Coda Netherlands”), and that the Terms and Conditions are hereby entered into and agreed upon between you and Coda Netherlands. 3. Prices.
All prices offered on the Web Store are inclusive of VAT at the applicable rate and any other taxes and additional charges.
4. Conformity
Coda Netherlands guarantees that the Digital Product complies with the description provided on the relevant Web Store’s product page, with the reasonable requirements of reliability and/or usability and with the applicable laws that exist on the date on which the purchase transaction is made. Coda Netherlands shall have no obligation or liability in respect of any defect or non-conformity discovered after the redemption or activation of the Digital Product as specified above.
5. Statutory Right of Withdrawal
You have a statutory right under EU/EEA or UK regulations to withdraw from certain contracts in respect of the purchase of the Digital Product. Please refer to this page for more information about the extent of your statutory right and how you may exercise it. However, this right can be ‘waived’ at the point of sale by expressly requesting that the relevant digital content be supplied immediately and acknowledging that the right to withdraw will then be lost upon that supply beginning.
6. Governing law and dispute resolution
These Terms and Conditions (and Terms of Use incorporated herein by reference) shall be governed by and construed according to the laws of the Netherlands without regard to its conflict-of-law provisions. We will endeavor to amicably resolve any disputes that arise out of or in connection with these Terms and Conditions (including any question regarding its existence, validity or termination), but in the event that such efforts fail, such disputes will be finally resolved by the Amsterdam District Court following proceedings in English before the Chamber of International Commercial Matters (“Netherlands Commercial Court” or “NCC District Court”), to the exclusion of the jurisdiction of any other courts, provided that such choice of law/jurisdiction will not deprive you of any mandatory consumer protections of your home country (if different). An action for interim measures, including protective measures, available under Dutch law may be brought in the NCC’s court in Summary Proceedings (CSP) in proceedings in English. Any appeals against NCC or CSP judgments will be submitted to the Amsterdam Court of Appeal’s Chamber for International Commercial Matters (“Netherlands Commercial Court of Appeal” or “NCCA”). The NCC Rules of Procedure apply.
Notwithstanding the exclusive jurisdiction of the NCC, if you are a Dutch user of the Web Store, you may for a period of one month after Coda invokes in writing this Section 6, opt for the resolution of the dispute by the competent court under Dutch law.
We are obligated by applicable regulations to provide a link to the European Commission’s online dispute resolution platform, which you can access here. However, Coda Netherlands is neither obligated nor willing to participate in dispute settlement procedures before a consumer arbitration board.
7. Binding and enforceable
You understand and accept that these Terms and Conditions constitute a binding and enforceable contract between you and Coda Netherlands, and that the rights and obligations set out in these Terms and Conditions shall be effective between you and Coda Netherlands when you signify your acceptance.
8. Use of Web Store and Purchase of Digital Product by Children Under 18.
Digital Products are not directed to individuals under the age of eighteen (18). By using the Web Store or purchasing Digital Products, you confirm that you are at least 18 years old, or of the legal age of majority in your place of residence, or that you have the consent of a parent or legal guardian.

("KONAMI"), non può essere trasferito ad altre persone né convertito in valuta fiat o altri beni di valore monetario, né in mezzi di pagamento legali.
2. Condizioni di vendita
In relazione ai tuoi acquisti, confermi che: (i) stai acquistando il Prodotto digitale per tuo consumo esclusivo e personale; (ii) non avrai alcun diritto di noleggiare, affittare, prestare, vendere, ridistribuire o concedere in sublicenza il Prodotto digitale acquistato su questo Negozio online; e (iii) rispetterai in ogni momento tutte le leggi, le norme, i regolamenti e i termini e le restrizioni applicabili imposti da Coda e/o KONAMI nell'acquisto e nell'utilizzo del Prodotto digitale.
3. Account KONAMI ID
Al fine di effettuare transazioni o accedere a determinati programmi di ricompensa, promozioni, funzionalità o servizi sul Negozio online, potremmo richiedere all'utente di utilizzare il proprio account KONAMI ID registrato per il Gioco. Effettuando l'accesso con il proprio account KONAMI ID, l'utente conferma e accetta di aver fornito a Coda informazioni complete e accurate su di sé a fini di verifica e di essere responsabile del mantenimento della riservatezza del proprio account KONAMI ID, della relativa password e di tutte le attività che avvengono sotto il proprio account KONAMI ID. In caso di accesso non autorizzato al tuo account KONAMI ID sul Negozio online, devi informare immediatamente Coda.
Coda si riserva il diritto, a sua esclusiva discrezione, di sospendere o interrompere l'accesso o l'utilizzo del Negozio online tramite l'account KONAMI ID in qualsiasi momento se:
tentate di intraprendere, o intraprendete indirettamente, qualsiasi comportamento vietato dai Termini del Web Store;
violi una qualsiasi clausola dei Termini del Web Store e, se la violazione può essere sanata, non provvedi a farlo entro trenta (30) giorni dal ricevimento della comunicazione da parte di Coda che specifica tale violazione;
Coda è tenuta a farlo da qualsiasi autorità di regolamentazione o organo di polizia;
hai fornito informazioni false o inesatte e non hai fornito informazioni veritiere o corrette entro quindici (15) giorni dalla ricezione della comunicazione scritta da parte di Coda che richiedeva tali informazioni; oppure
Coda ha stabilito che la sicurezza del tuo account KONAMI ID è stata compromessa o che il tuo account è stato consultato in modo non autorizzato e non hai intrapreso alcuna azione entro cinque (5) giorni dalla ricezione della comunicazione scritta da parte di Coda che specifica le azioni correttive richieste.
L'utente è l'unico responsabile della verifica e della conferma della completezza e dell'accuratezza del proprio account KONAMI ID o di qualsiasi altra informazione richiesta inserita durante la transazione o quando accede a determinati programmi di ricompensa, promozioni, funzionalità o servizi sul Web Store. Procedendo, l'utente riconosce che Coda non è responsabile per errori o rimborsi dovuti a dettagli errati dell'account KONAMI ID o qualsiasi altra informazione inserita dall'utente.
4. Descrizione e consegna del prodotto

Se utilizzi un bonifico bancario come metodo di pagamento, le coordinate bancarie fornite saranno raccolte direttamente dai nostri partner di pagamento. Coda non raccoglie, archivia o elabora le informazioni relative al tuo conto bancario. Ci riserviamo il diritto di rifiutare o declinare qualsiasi transazione per qualsiasi motivo o di impostare limiti sui tipi e/o sugli importi delle transazioni.
6. Controversie ed errori
Controversie: contattaci all'indirizzo se non hai ricevuto il Prodotto digitale, se ritieni che ti sia stato addebitato un importo errato o se hai riscontrato problemi relativi al pagamento.
Non è consentito fornire dichiarazioni false o fuorvianti al momento della presentazione del reclamo o durante la successiva indagine relativa alla controversia. Esamineremo tutte le controversie che ci vengono segnalate e faremo ogni ragionevole sforzo per risolverle. Tuttavia, la risoluzione definitiva di tali controversie sarà a esclusiva discrezione di Coda.
Per qualsiasi domanda relativa ai giochi KONAMI o agli oggetti di gioco, utilizzare il modulo di richiesta disponibile all'interno del gioco.
Gestione degli errori: nell'ambito del processo di gestione delle controversie o separatamente da esso, potremmo determinare che è stato commesso un errore. Se determiniamo che ti è stato addebitato un importo errato o eccessivo, accrediteremo il tuo account o provvederemo in altro modo al rimborso per correggere l'errore. Se concludiamo che non ti è stato addebitato un importo che avresti dovuto pagare o che ti è stato addebitato un importo inferiore a quello dovuto, potremmo richiederti un pagamento per correggere l'errore di conseguenza.
Rimborsi: l'utente riconosce e comprende che tutti gli acquisti effettuati con successo sul Negozio online sono definitivi e non cancellabili. Non saranno accettati resi né saranno emessi rimborsi, salvo diversamente specificato nei presenti Termini e condizioni. Nel caso in cui venga effettuato un rimborso a seguito di una controversia e/o di un'indagine sulla gestione degli errori, il pagamento sarà accreditato sullo strumento di pagamento dell'utente in conformità con i termini e i tempi stabiliti dalla banca o dal fornitore di servizi di pagamento.
7. Varie
Limitazione di responsabilità. SENZA LIMITAZIONE DEI TERMINI DI UTILIZZO, NELLA MISURA IN CUI NON VIETATO DALLA LEGGE, IN NESSUN CASO CODA, KONAMI O QUALSIASI DELLE LORO RISPETTIVE SOCIETÀ MADRI, CONTROLLATE, AFFILIATE O FUNZIONARI, AMMINISTRATORI, DIPENDENTI O ALTRI RAPPRESENTANTI (LE "PARTI INTERESSATE") SARANNO RESPONSABILI PER LESIONI PERSONALI O DANNI INCIDENTALI, SPECIALI, INDIRETTI O CONSEQUENZIALI DI QUALSIASI TIPO, INCLUSE, A TITOLO ESEMPLIFICATIVO, LE PERDITE DI PROFITTI, LA PERDITA DI DATI, L'INTERRUZIONE DELL'ATTIVITÀ COMMERCIALE O QUALSIASI ALTRO DANNO O PERDITA DERIVANTI O CORRELATI ALL'UTILIZZO O ALL'IMPOSSIBILITÀ DI UTILIZZARE IL NEGOZIO ONLINE O I PRODOTTI DIGITALI, INDIPENDENTEMENTE DALLA CAUSA, DALLA TEORIA DI RESPONSABILITÀ (CONTRATTUALE, EXTRACONTRATTUALE O DI ALTRO TIPO) E ANCHE SE QUALSIASI PARTE INTERESSATA È STATA INFORMATA DELLA POSSIBILITÀ DI TALI DANNI. ALCUNE GIURISDIZIONI NON CONSENTONO LA LIMITAZIONE DI RESPONSABILITÀ PER LESIONI PERSONALI O DANNI INCIDENTALI O CONSEQUENZIALI, QUINDI TALE LIMITAZIONE POTREBBE NON ESSERE APPLICABILE ALL'UTENTE. IN NESSUN CASO LA RESPONSABILITÀ TOTALE DELLE PARTI INTERESSATE NEI CONFRONTI DELL'UTENTE PER TUTTI I DANNI (AD ECCEZIONE DI QUANTO PREVISTO DALLA LEGGE APPLICABILE IN CASO DI LESIONI PERSONALI) POTRÀ SUPERARE IL PREZZO EFFETTIVO PAGATO DALL'UTENTE PER IL PRODOTTO DIGITALE. LE PRECEDENTI LIMITAZIONI SI APPLICANO ANCHE SE IL RIMEDIO SOPRA INDICATO NON RAGGIUNGE IL SUO SCOPO ESSENZIALE.
Rinuncia; Esclusione di responsabilità. Nella misura massima consentita dalle leggi e dai regolamenti applicabili, l'utente accetta di sollevare e manlevare le Parti interessate da qualsiasi responsabilità e rinuncia a qualsiasi causa di azione legale relativa a reclami, costi, lesioni, perdite o danni di qualsiasi tipo derivanti da o in relazione al Negozio online e ai Prodotti digitali, sia in base a una teoria di contratto, illecito civile (inclusa la negligenza), garanzia o altra teoria. In nessun caso l'utente potrà, e con la presente rinuncia irrevocabilmente a qualsiasi diritto di citare in giudizio le Parti interessate o di richiedere o ottenere un provvedimento ingiuntivo o altro provvedimento equo in relazione al Negozio online e a qualsiasi Prodotto digitale.
Separabilità. Senza limitazione delle Condizioni d'uso, se una qualsiasi parte, termine o disposizione dei presenti Termini e condizioni è ritenuta illegale, in conflitto con qualsiasi legge o altrimenti non valida, la parte o le parti rimanenti saranno considerate separabili e non saranno influenzate da tale determinazione, e i diritti e gli obblighi delle parti saranno interpretati e applicati come se i presenti Termini e condizioni non contenessero la parte, il termine o le disposizioni particolari ritenute illegali o non valide.
PARTE II TERMINI E CONDIZIONI AGGIUNTIVI - SPECIFICI PER PAESE
Unione Europea (UE)/Spazio Economico Europeo (SEE)/Svizzera/Regno Unito (UK)
1. Ambito di applicazione
Salvo diversamente specificato, se l'utente risiede o si trova nell'UE/SEE, in Svizzera o nel Regno Unito, le presenti disposizioni (le "Disposizioni UE") regolano l'acquisto di Prodotti digitali in aggiunta alla Parte I (Termini e condizioni generali) di cui sopra. In caso di conflitto tra le presenti Disposizioni UE e la Parte I (Termini e condizioni generali) o i Termini di utilizzo, le presenti Disposizioni UE prevarranno nella misura necessaria a risolvere il conflitto.
2. Fornitore del Prodotto digitale
L'utente comprende e accetta che il Prodotto digitale gli viene venduto da Coda Netherlands Holdings B.V., con sede legale in Strawinskylaan 1647, Tower Seven, 16° piano, 1077XX Amsterdam e partita IVA NL 862518866B01 ("Coda Netherlands"), e che i Termini e condizioni sono stipulati e concordati tra l'utente e Coda Netherlands. 3. Prezzi
Tutti i prezzi offerti nel Negozio online sono comprensivi dell’IVA applicabile e di tutte le altre imposte e spese aggiuntive.
4. Conformità
Coda Netherlands garantisce che il Prodotto Digitale è conforme alla descrizione fornita nella pagina del prodotto del Negozio Online pertinente, ai ragionevoli requisiti di affidabilità e/o usabilità e alle leggi applicabili in vigore alla data in cui viene effettuata la transazione di acquisto. Coda Netherlands non avrà alcun obbligo o responsabilità in relazione a eventuali difetti o non conformità riscontrati dopo il riscatto o l'attivazione del Prodotto Digitale come sopra specificato.
5. Diritto di recesso previsto dalla legge
Ai sensi delle normative UE/SEE o del Regno Unito, l'utente ha il diritto legale di recedere da determinati contratti relativi all'acquisto del Prodotto digitale. Per ulteriori informazioni sulla portata del diritto legale e sulle modalità di esercizio dello stesso, consultare la pagina . Tuttavia, tale diritto può essere "rinunciato" al momento della vendita richiedendo espressamente che il contenuto digitale pertinente sia fornito immediatamente e riconoscendo che il diritto di recesso verrà perso al momento dell'inizio della fornitura.
6. Legge applicabile e risoluzione delle controversie
I presenti Termini e condizioni (e i Termini di utilizzo qui incorporati per riferimento) sono regolati e interpretati in base alle leggi dei Paesi Bassi, indipendentemente dalle disposizioni in materia di conflitto di leggi. Ci impegneremo a risolvere in modo amichevole qualsiasi controversia derivante da o in relazione ai presenti Termini e condizioni (compresa qualsiasi questione relativa alla loro esistenza, validità o risoluzione), ma nel caso in cui tali sforzi falliscano, tali controversie saranno risolte in via definitiva dal Tribunale distrettuale di Amsterdam a seguito di un procedimento in lingua inglese dinanzi alla Camera delle questioni commerciali internazionali ("Tribunale commerciale dei Paesi Bassi" o "Tribunale distrettuale NCC"), con esclusione della giurisdizione di qualsiasi altro tribunale, a condizione che tale scelta di legge/giurisdizione non privi l'utente di alcuna tutela obbligatoria dei consumatori del proprio paese di residenza (se diverso). Un'azione per misure provvisorie, comprese misure cautelari, disponibili ai sensi della legge olandese, può essere intentata dinanzi al tribunale NCC in un procedimento sommario (CSP) in inglese. Eventuali ricorsi contro le sentenze NCC o CSP saranno presentati alla Camera per le questioni commerciali internazionali della Corte d'appello di Amsterdam ("Corte d'appello commerciale dei Paesi Bassi" o "NCCA"). Si applicano le norme procedurali NCC.
Nonostante la giurisdizione esclusiva dell'NCC, se sei un utente olandese del Negozio online, puoi, per un periodo di un mese dopo che Coda ha invocato per iscritto la presente Sezione 6, optare per la risoluzione della controversia da parte del tribunale competente ai sensi della legge olandese.
Siamo obbligati dalle normative applicabili a fornire un link alla piattaforma di risoluzione delle controversie online della Commissione Europea, a cui puoi accedere qui . Tuttavia, Coda Netherlands non è né obbligata né disposta a partecipare a procedure di risoluzione delle controversie dinanzi a un collegio arbitrale dei consumatori.
7. Vincolante e applicabile
L'utente comprende e accetta che i presenti Termini e condizioni costituiscono un contratto vincolante ed esecutivo tra l'utente e Coda Netherlands e che i diritti e gli obblighi stabiliti nei presenti Termini e condizioni saranno efficaci tra l'utente e Coda Netherlands al momento dell'accettazione da parte dell'utente.
8. Utilizzo del negozio online e acquisto di prodotti digitali da parte di minori di 18 anni.
I prodotti digitali non sono destinati a persone di età inferiore ai diciotto (18) anni. Utilizzando il negozio online o acquistando prodotti digitali, l'utente conferma di avere almeno 18 anni, o di aver raggiunto la maggiore età nel proprio luogo di residenza, o di avere il consenso di un genitore o tutore legale.
