BY CLICKING “BUY NOW”, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND YOU AGREE TO BE BOUND BY, THE FOLLOWING TERMS AND CONDITIONS OF SALE (THESE “TERMS AND CONDITIONS” OR THESE “TERMS”), IN ADDITION TO THE TERMS OF USE (the “TOU” or “TERMS OF USE”) AND THE PRIVACY NOTICE (collectively the “WEB STORE TERMS”), WHICH ARE HEREBY INCORPORATED HEREIN BY REFERENCE. Unless the context otherwise requires, all capitalized terms used but not defined herein shall have the meanings set forth in the Terms of Use.
YOU ALSO HEREBY ACKNOWLEDGE AND AGREE THE DIGITAL PRODUCTS (THE “WEB STORE”) ARE BEING SOLD TO YOU BY CODA AND THESE TERMS FORM A CONTRACT BETWEEN YOU, ON THE ONE HAND, AND CODA, ON THE OTHER HAND. THESE TERMS AND THE TOU CONTAIN LIMITATIONS OF LIABILITY AND OTHER LEGALLY BINDING CONTRACTUAL TERMS. THESE CLAUSES AFFECT YOUR LEGAL RIGHTS AND REMEDIES, AND YOU SHOULD REVIEW THEM CAREFULLY BEFORE CLICKING “BUY NOW” OR OTHERWISE ACCEPTING THESE TERMS. YOU MAY NOT ORDER OR OBTAIN PRODUCTS OR SERVICES FROM THIS WEB STORE IF YOU (A) DO NOT AGREE TO THESE TERMS, (B) ARE NOT THE OLDER OF (i) AT LEAST 18 YEARS OF AGE OR (ii) LEGAL AGE TO FORM A BINDING CONTRACT WITH US, OR (C) ARE PROHIBITED FROM ACCESSING OR USING THIS WEB STORE OR ANY OF THIS WEB STORE'S CONTENTS, PRODUCTS OR SERVICES BY APPLICABLE LAW.
These Terms composed of Part I (General Terms and Conditions) and Part II (Additional Terms and Conditions) are an integral part of the TOU that apply generally to the use of the Web Store. You should also carefully review our Privacy Notice before placing an order through this Web Store.
PART I GENERAL TERMS AND CONDITIONS
1. No Monetary Value
You acknowledge and understand that Digital Product has no monetary value and can only be used in the video game (the “Game”) published by Konami Digital Entertainment Co., Ltd. ("KONAMI"), may not be transferred to another person or redeemed for fiat currencies or other things of monetary value, or means of legal tender.
2. Sale Conditions
In respect of your purchases, you confirm that: (i) you are purchasing the Digital Product for your own exclusive and personal consumption; (ii) you shall have no right to rent, lease, lend, sell, redistribute or sublicense the Digital Product you acquire on this Web Store; and (iii) you at all times comply with all applicable laws, rules, regulations and terms and restrictions placed by Coda and/or KONAMI in your purchase and use of the Digital Product.
3. KONAMI ID Account
In order to make transactions or access certain reward schemes, promotions, features or services at the Web Store, we may require you to use your KONAMI ID account registered for the Game. By logging in using your KONAMI ID account, you confirm and agree that you have provided Coda with complete and accurate information about yourself for verification purposes, and that you are responsible for maintaining the confidentiality of your KONAMI ID account, its password, and all activities that occur under your KONAMI ID account. In the event of unauthorized access to your KONAMI ID account at the Web Store, you must notify Coda immediately.
Coda reserves the right at its sole discretion to suspend or terminate your access or use of the Web Store using the KONAMI ID account at any time if:
you attempt to engage in, or indirectly engage in any conduct prohibited under the Web Store Terms;
you breach any clause of the Web Store Terms and, if the breach may be remedied; you fail to do so within thirty (30) days from receiving notice from Coda specifying such breach;
Coda is required to do so by any regulatory authority or law enforcement body;
you have provided us with false or inaccurate information and have failed to provide us with the true or correct information within fifteen (15) days from receiving written notice from Coda requesting such information; or
Coda has determined that the security of your KONAMI ID account has been compromised, or your account has been accessed in an unauthorized manner, and you fail to take action within five (5) days from receiving written notice from Coda specifying the required corrective action.
You are solely responsible for verifying and confirming your KONAMI ID account or any other required information entered during the transaction or when accessing certain reward schemes, promotions, features or services at the Web Store is complete and accurate. By proceeding, you acknowledge that Coda is not liable for errors or refunds due to incorrect KONAMI ID account details or any other information entered by you.
4. Product Description and Delivery
We take every effort to ensure that the product descriptions on the Web Store are as accurate as possible. However, to the extent permitted by applicable law, we do not warrant that such product descriptions are complete or correct.
We do not develop or publish Digital Products offered on the Web Store. KONAMI is the publisher of Digital Products. Other than complying with our Web Store Terms, your use of any Digital Product is subject to KONAMI’s applicable licence terms. KONAMI is solely responsible for delivery of the Digital Product to you.
You understand that while you may “purchase” the Digital Product offered on the Web Store, you do not in fact own or have any intellectual property rights in the Digital Product obtained through the Web Store. Rather, you purchase limited rights to access and use the Digital Product for your exclusive personal consumption. You may not decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Digital Product.
5. Prices and Payment Terms
All prices, discounts, and promotions posted on this Web Store are subject to change without notice.
To make a purchase on the Web Store, you must have a valid and eligible mobile phone account with one of our partner mobile network operators or a valid payment instrument issued or recognized by our payment partners.
You are solely liable for the use of your selected payment instruments in connection with the purchase on this Web Store, and Coda shall have no liability to you or to any third party for any unauthorized use of your payment instruments.
You represent and warrant that (i) the payment information you provide to us is true, correct, and complete, (ii) you are duly authorized to use the chosen payment instrument for the purchase, (iii) you will pay charges incurred by you at the posted prices, including all applicable taxes, duties, currency exchange fees, data charges, and related charges, if any.
If you use a bank transfer as a method of payment, any bank details that you provide will be collected directly by our payment partners. Coda does not collect, store, or process your bank account information. For information on how we process other payment data that you may provide in the course of making a purchase, please refer to our Privacy Notice.
We reserve the right to reject or decline any transaction for any reason or set limits on transaction types and/or amounts.
6. Disputes and Errors
Disputes: Please contact us if you did not receive the Digital Product, if you believe you have been charged in error or if you have experienced any payment-related issues.
You must not make any false or misleading statements when submitting your complaint, or during the subsequent investigation of a dispute. We will investigate all disputes that are filed with us and will make reasonable efforts to resolve them. However, the ultimate resolution of such disputes shall be at Coda’ sole discretion.
If you have any inquiries related to KONAMI games or in-game items, please use the inquiry form available within the Game.
Error handling: As part of or separate from the dispute handling process, we may determine that a mistake has been made. If we determine that you have been incorrectly charged or overcharged, we will credit your account or otherwise arrange for a refund to rectify the mistake. If we conclude that you were not charged when you ought to have been, or that you have been undercharged, we may collect a payment from you to rectify the mistake accordingly.
Refunds: You acknowledge and understand that all purchases successfully made on the Web Store are final and non-cancellable. No returns will be accepted, and no refunds will be issued unless expressly specified otherwise in these Terms and Conditions. In the event that a refund is made to you after dispute and/or error handling investigation, your payment instrument will be credited in accordance with the terms and time frame set by your bank or payment service provider.
7. Miscellaneous
Limitation of Liability. WITHOUT LIMITATION OF THE TOU, TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL CODA, KONAMI OR ANY OF THEIR RESPECTIVE PARENTS, SUBSIDIARIES, AFFILIATES OR OFFICERS, DIRECTORS, EMPLOYEES OR OTHER REPRESENTATIVES (THE “RELEVANT PARTIES”) BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE WEB STORE OR THE DIGITAL PRODUCTS, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF ANY RELEVANT PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU. IN NO EVENT SHALL ANY OF THE RELEVANT PARTIES’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) HEREUNDER EXCEED THE ACTUAL PRICE PAID BY YOU FOR THE DIGITAL PRODUCT. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF THE ABOVE-STATED REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
Release; Waiver. To the greatest extent permitted by the applicable laws and regulations, you hereby agree to release and hold harmless the Relevant Parties from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Web Store and the Digital Products, whether under a theory of contract, tort (including negligence), warranty or other theory. In no event shall you, and you hereby irrevocably waive, any right to sue the Relevant Parties or to seek or obtain injunctive or other equitable relief in connection with the Web Store and any Digital Product.
Severability. Without limitation of the TOU, if any part, term or provision of these Terms and Conditions is held to be illegal, in conflict with any law or otherwise invalid, the remaining portion or portions shall be considered severable and not be affected by such determination, and the rights and obligations of the parties shall be construed and enforced as if these Terms and Conditions did not contain the particular part, term or provisions held to be illegal or invalid.
PART II ADDITIONAL TERMS AND CONDITIONS – COUNTRY-SPECIFIC
INDONESIA
1. Scope of Application
If you are residing in or located in the Republic of Indonesia, these provisions (the “Indonesia Provisions”) shall govern your purchase of Digital Product in addition to Part I (General Terms and Conditions) above, unless otherwise specified. In the event of any conflict between these Indonesia Provisions and Part I (General Terms and Conditions) or Web Store Terms, these Indonesia Provisions shall control to the extent necessary to resolve the conflict.
2. Provider of Digital Product
You understand and accept that the Digital Product is being sold to you by PT Coda Indonesia, having its registered address at Sampoerna Strategic Square, South Tower Level 19, Jalan Jend. Sudirman Kav. 45-46, Jakarta Selatan 12930, Indonesia (“Coda Indonesia”), and that the Terms are hereby entered into and agreed upon between you and Coda Indonesia. Coda Indonesia may be reached by users in Indonesia through SUPPORT PAGE.
3. Use of Web Store and Purchase of Digital Product by Persons Under 21
The use of Web Store and purchases of Digital Product on the Web Store are not directed to persons under the age of twenty one (21) in Indonesia, are not married or under guardianship (“minors”) and may not be used by such minors without the permission and consent of their parent or lawful guardian. You hereby waive every right under the applicable law to cancel or revoke any and all consents that you have been given based on these Terms and Conditions when you are considered as an adult under the applicable law.
4. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed according to the laws of the Republic of Indonesia without regard to its conflicts-of-law provisions. We shall endeavor to amicably resolve any disputes that arise out of or in connection with these Terms and Conditions (including any question regarding its existence, validity, or termination), but in the event that such efforts shall fail, such disputes shall be referred to the jurisdiction of the District Court of Jakarta Selatan, to the exclusion of all courts in any other venue, except for complaints filed by users classified under the law as consumers, who may file such complaints with the court with jurisdiction over their domicile.

Kecuali konteksnya mensyaratkan lain, semua istilah yang ditulis dengan huruf kapital yang digunakan tetapi tidak didefinisikan dalam dokumen ini memiliki arti yang ditetapkan dalam Syarat Penggunaan.
ANDA JUGA DENGAN INI MENGAKUI DAN SETUJU BAHWA PRODUK DIGITAL DI SITUS WEB TOKO INI (“TOKO WEB”) DIJUAL KEPADA ANDA OLEH CODA, DAN SYARAT-SYARAT INI MENJADI PERJANJIAN ANTARA ANDA, DI SATU SISI, DAN CODA, DI SISI LAIN. SYARAT-SYARAT INI DAN SYARAT PENGGUNAAN MENGANDUNG BATASAN TANGGUNG JAWAB DAN KLAUSUL KONTRAKTUAL LAIN YANG MENGIKAT SECARA HUKUM. KLAUSUL-KLAUSUL INI MEMPENGARUHI HAK-HAK DAN SERTA PEMULIHAN BERDASARKAN HUKUM, DAN ANDA HARUS MENINJAUNYA DENGAN SEKSAMA DAN TELITI SEBELUM ANDA MENGKLIK “BELI SEKARANG” ATAU MENERIMA SYARAT-SYARAT INI DENGAN CARA LAIN. ANDA TIDAK DAPAT MEMESAN ATAU MENDAPATKAN PRODUK ATAU LAYANAN DARI TOKO WEB INI JIKA ANDA (A) TIDAK SETUJU DENGAN SYARAT-SYARAT INI, (B) TIDAK MEMENUHI SYARAT USIA (i) SETIDAKNYA 18 TAHUN ATAU (ii) USIA YANG DIIZINKAN UNTUK MENGADAKAN KONTRAK YANG MENGIKAT DENGAN KAMI, ATAU (C) DILARANG MENGAKSES ATAU MENGGUNAKAN TOKO WEB INI ATAU KONTEN, PRODUK, ATAU LAYANAN TOKO WEB INI BERDASARKAN HUKUM YANG BERLAKU.
Syarat dan Ketentuan ini terdiri dari Bagian I (Syarat dan Ketentuan Umum) dan Bagian II (Syarat dan Ketentuan Tambahan) merupakan bagian integral dari Syarat Penggunaan yang berlaku secara umum untuk penggunaan Toko Web ini. Anda juga disarankan untuk membaca dengan cermat Pemberitahuan Privasi kami sebelum melakukan pemesanan melalui Toko Web ini.
BAGIAN I SYARAT DAN KETENTUAN UMUM
1. Tidak Memiliki Nilai Moneter
Anda mengakui dan memahami bahwa Produk Digital tidak memiliki nilai moneter dan hanya dapat digunakan dalam permainan video (“Gim”) yang diterbitkan oleh Konami Digital Entertainment Co., Ltd . ("KONAMI"), tidak dapat dialihkan atau dipindahtangankan kepada orang lain atau ditukar dengan mata uang fiat atau barang lain yang memiliki nilai moneter, atau alat pembayaran yang sah.
2. Syarat Penjualan
Sehubungan dengan pembelian Anda, Anda menegaskan bahwa: (i) Anda membeli Produk Digital untuk konsumsi pribadi dan eksklusif untuk Anda sendiri; (ii) Anda tidak memiliki hak untuk menyewakan, meminjamkan, menjual, mendistribusikan ulang, atau memberikan lisensi ulang (sublisensi) atas Produk Digital yang Anda peroleh di Toko Web ini; dan (iii) Anda senantiasa mematuhi semua hukum, peraturan, ketentuan, dan batasan yang ditetapkan oleh Coda dan/atau KONAMI dalam pembelian dan penggunaan Produk Digital oleh Anda.
3. Akun KONAMI ID
Untuk melakukan transaksi atau mengakses skema penghargaan, promosi, fitur, atau layanan tertentu di Toko Web, kami mungkin mewajibkan Anda untuk menggunakan akun KONAMI ID yang terdaftar untuk Gim. Dengan masuk (login) menggunakan akun KONAMI ID Anda, Anda menyatakan dan menyetujui bahwa Anda telah memberikan informasi lengkap dan akurat tentang diri Anda kepada Coda untuk tujuan verifikasi, dan bahwa Anda bertanggung jawab untuk menjaga kerahasiaan akun KONAMI ID Anda, kata sandi, dan semua aktivitas yang terjadi di bawah akun KONAMI ID Anda. Jika terjadi akses tidak sah ke akun KONAMI ID Anda di Toko Web, Anda harus segera memberitahu Coda.
Coda berhak, atas kebijakannya sendiri, untuk menangguhkan atau menghentikan akses atau penggunaan Anda terhadap Toko Web menggunakan akun KONAMI ID kapan saja jika:
Anda mencoba untuk terlibat dalam, atau secara tidak langsung terlibat dalam perilaku yang dilarang sesuai dengan Syarat dan Ketentuan Toko Web;
Anda melanggar ketentuan apa pun dalam Syarat dan Ketentuan Toko Web dan, jika pelanggaran tersebut dapat diperbaiki; Anda gagal melakukannya dalam waktu tiga puluh (30) hari sejak menerima pemberitahuan dari Coda yang menyebutkan pelanggaran tersebut;
Coda diwajibkan untuk melakukannya oleh otoritas regulasi atau badan penegak hukum;
Anda telah memberikan informasi yang salah atau tidak akurat kepada kami dan gagal memberikan informasi yang benar atau akurat dalam waktu lima belas (15) hari sejak menerima pemberitahuan tertulis dari Coda yang meminta informasi tersebut; atau
Coda telah menentukan bahwa keamanan Akun KONAMI ID Anda telah terkompromi, atau akun Anda diakses secara tidak sah, dan Anda gagal mengambil tindakan dalam waktu lima (5) hari sejak menerima pemberitahuan tertulis dari Coda yang menjelaskan tindakan korektif yang diperlukan.
Anda sepenuhnya bertanggung jawab untuk memverifikasi dan memastikan bahwa informasi akun KONAMI ID Anda atau informasi lain yang dimasukkan selama transaksi atau saat mengakses skema penghargaan, promosi, fitur, atau layanan tertentu di Toko Web adalah lengkap dan akurat. Dengan melanjutkan, Anda mengakui bahwa Coda tidak bertanggung jawab atas kesalahan atau pengembalian dana akibat detail akun KONAMI ID yang salah atau informasi lain yang dimasukkan oleh Anda.
4. Deskripsi dan Pengiriman Produk
Kami berusaha semaksimal mungkin untuk memastikan bahwa deskripsi produk di Toko Web seakurat mungkin. Namun, sejauh diizinkan oleh hukum yang berlaku, kami tidak menjamin bahwa deskripsi produk tersebut lengkap atau akurat.

Anda memahami bahwa meskipun Anda dapat "membeli" Produk Digital yang ditawarkan di Toko Web, Anda sebenarnya tidak memiliki atau memiliki hak kekayaan intelektual atas Produk Digital yang diperoleh melalui Toko Web. Sebaliknya, Anda membeli hak terbatas untuk mengakses dan menggunakan Produk Digital untuk konsumsi pribadi Anda sendiri. Anda dilarang untuk mendekompilasi, merekayasa balik, membongkar, mencoba mengungkap kode sumber, memodifikasi, atau membuat karya turunan dari Produk Digital.
5. Ketentuan Harga dan Pembayaran
Semua harga, diskon, dan promosi yang diposting di Toko Web ini dapat berubah tanpa pemberitahuan sebelumnya.
Untuk melakukan pembelian di Toko Web, Anda harus memiliki akun telepon seluler yang valid dan memenuhi syarat dari salah satu operator jaringan seluler mitra kami atau alat pembayaran yang valid yang diterbitkan atau diakui oleh mitra pembayaran kami.
Anda sepenuhnya bertanggung jawab atas penggunaan alat pembayaran yang Anda pilih sehubungan dengan pembelian di Toko Web ini, dan Coda tidak akan bertanggung jawab kepada Anda atau pihak ketiga mana pun atas penggunaan yang tidak sah dari alat pembayaran Anda.
Anda menyatakan dan menjamin bahwa (i) informasi pembayaran yang Anda berikan kepada kami adalah benar, akurat, dan lengkap, (ii) Anda berwenang secara sah untuk menggunakan alat pembayaran yang dipilih untuk pembelian, (iii) Anda akan membayar biaya yang timbul atas pembelian Anda sesuai dengan harga yang tercantum, termasuk semua pajak, bea, biaya pertukaran mata uang, biaya data, dan biaya terkait lainnya, jika ada.
Jika Anda menggunakan transfer bank sebagai metode pembayaran, setiap rincian bank yang Anda berikan akan dikumpulkan langsung oleh mitra pembayaran kami. Coda tidak mengumpulkan, menyimpan, atau memproses informasi rekening bank Anda. Untuk informasi tentang cara kami memproses data pembayaran lain yang mungkin Anda berikan selama proses pembelian, silakan merujuk ke Pemberitahuan Privasi kami.
Kami berhak menolak atau menolakan transaksi apa pun dengan alasan apa pun atau menetapkan batasan pada jenis transaksi dan/atau jumlahnya.
6. Sengketa dan Kesalahan
Sengketa: Silakan hubungi kami di sini atau jika Anda tidak menerima Produk Digital, jika Anda yakin telah dikenakan biaya karena kesalahan atau jika Anda mengalami masalah terkait pembayaran.
Anda tidak boleh membuat pernyataan palsu atau menyesatkan saat Anda mengajukan keluhan atau selama penyelidikan sengketa. Kami akan menyelidiki semua sengketa yang diajukan kepada kami dan akan melakukan upaya yang wajar untuk menyelesaikannya. Namun, penyelesaian akhir sengketa tersebut sepenuhnya merupakan kebijakan mutlak Coda sendiri.
Jika Anda memiliki pertanyaan atau keluhan tentang Gim atau penggunaan Produk Digital dalam Gim, silakan hubungi KONAMI melalui formulir pertanyaan yang tersedia di dalam Gim.
Penanganan kesalahan: Sebagai bagian dari atau terpisah dari proses penanganan sengketa, kami dapat menentukan bahwa telah terjadi kesalahan. Jika kami menentukan bahwa Anda telah ditagih/dikenakan biaya secara salah atau lebih mahal, kami akan mengkreditkan akun Anda atau mengatur pengembalian dana untuk memperbaiki kesalahan tersebut. Jika kami menyimpulkan bahwa Anda tidak dikenakan biaya padahal seharusnya dikenakan, atau bahwa Anda dikenakan biaya kurang, kami dapat menagih pembayaran dari Anda untuk memperbaiki kesalahan tersebut.
Pengembalian dana: Anda mengakui dan memahami bahwa semua pembelian yang berhasil dilakukan di Toko Web bersifat final dan tidak dapat dibatalkan. Pengembalian barang tidak akan diterima, dan pengembalian dana tidak akan diberikan kecuali secara tegas ditentukan lain dalam Syarat dan Ketentuan ini. Jika pengembalian dana diberikan kepada Anda setelah penyelidikan penanganan sengketa dan/atau kesalahan, alat pembayaran Anda akan dikreditkan sesuai dengan syarat dan waktu yang ditetapkan oleh bank atau penyedia layanan pembayaran Anda.
7. Lain-lain
Pengecualian Tanggung Jawab. TANPA MEMBATASI SYARAT PENGGUNAAN, SEJAUH TIDAK DILARANG OLEH HUKUM, DALAM KONDISI APAPUN, CODA, KONAMI, ATAU INDUK PERUSAHAAN, ANAK PERUSAHAAN, AFILIASI, ATAU PEJABAT, DIREKTUR, KARYAWAN, ATAU WAKIL LAINNYA (“PIHAK TERKAIT”) TIDAK AKAN BERTANGGUNG JAWAB ATAS CEDERA PRIBADI ATAU KERUGIAN INSIDENTAL, KHUSUS, TIDAK LANGSUNG, ATAU KONSEKUENSIAL APAPUN, TERMASUK, TANPA TERBATAS PADA, KERUGIAN ATAS KEHILANGAN KEUNTUNGAN, KEHILANGAN DATA, GANGGUAN BISNIS, ATAU KERUGIAN ATAU KEHILANGAN LAINNYA, YANG TIMBUL DARI ATAU BERKAITAN DENGAN PENGGUNAAN ATAU KETIDAKMAMPUAN ANDA UNTUK MENGGUNAKAN TOKO WEB ATAU PRODUK DIGITAL, TERLEPAS DARI PENYEBABNYA, TERLEPAS DARI TEORI PERTANGGUNGJAWABAN (KONTRAK, PERBUATAN MELAWAN HUKUM, ATAU LAINNYA), DAN BAHKAN JIKA PIHAK YANG BERKAITAN TELAH DIBERITAHU TENTANG KEMUNGKINAN KERUGIAN TERSEBUT. BEBERAPA YURISDIKSI TIDAK MENGIZINKAN PEMBATASAN TANGGUNG JAWAB ATAS CEDERA PRIBADI, ATAU KERUGIAN INSIDENTAL ATAU KONSEKUENSIAL, SEHINGGA PEMBATASAN INI MUNGKIN TIDAK BERLAKU BAGI ANDA. DALAM KONDISI APAPUN, TOTAL TANGGUNG JAWAB PIHAK YANG BERKENAAN TERHADAP ANDA UNTUK SEMUA KERUGIAN (KECUALI SEBAGAIMANA DITENTUKAN OLEH HUKUM YANG BERLAKU DALAM KASUS YANG MELIBATKAN CEDERA PRIBADI) DI BAWAH INI TIDAK AKAN MELEBIHI HARGA SEBENARNYA YANG ANDA BAYAR UNTUK PRODUK DIGITAL TERKAIT. BATASAN DI ATAS AKAN BERLAKU BAHKAN JIKA PENYELESAIAN YANG DIATUR DI ATAS GAGAL MEMENUHI TUJUAN UTAMANYA.
Pelepasan; Pengesampingan. Sejauh diizinkan oleh hukum dan peraturan perundang-undangan yang berlaku, Anda dengan ini setuju untuk membebaskan dan melepaskan Pihak Terkait yang bersangkutan dari segala tanggung jawab, dan mengesampingkan segala tuntutan hukum, yang berkaitan dengan klaim, biaya, cedera, kerugian, atau kerusakan apa pun yang timbul dari atau sehubungan dengan Toko Web dan Produk Digital, baik berdasarkan teori kontrak, perbuatan melawan hukum (termasuk kelalaian), jaminan, atau teori lain. Dalam keadaan apa pun, Anda, dan dengan ini secara tidak dapat ditarik kembali, melepaskan hak untuk menggugat Pihak Terkait atau mencari atau memperoleh putusan sela ganti rugi dari pengadilan (injunctive relief) atau ganti rugi lain yang bersifat adil sehubungan dengan Toko Web dan Produk Digital apa pun.
Keterpisahan. Tanpa membatasi Ketentuan Penggunaan, jika bagian, ketentuan, atau ketentuan mana pun dari Syarat dan Ketentuan ini dinyatakan ilegal, bertentangan dengan undang-undang, atau tidak sah, bagian atau ketentuan yang lainnya akan dianggap terpisah dan tidak terpengaruh oleh keputusan tersebut, dan hak dan kewajiban para pihak akan ditafsirkan dan diberlakukan seolah-olah Syarat dan Ketentuan ini tidak mengandung bagian, syarat, atau ketentuan yang dinyatakan ilegal atau tidak sah.
BAGIAN II SYARAT DAN KETENTUAN TAMBAHAN – KHUSUS NEGARA
INDONESIA
1. Ruang Lingkup Penerapan
Jika Anda berdomisili atau berlokasi di wilayah negara Republik Indonesia, syarat dan ketentuan ini (“Ketentuan Indonesia”) akan mengatur pembelian Produk Digital Anda sebagai tambahan dari Bagian I (Syarat dan Ketentuan Umum) di atas, kecuali ditentukan lain. Jika terdapat pertentangan antara Ketentuan Indonesia dan Bagian I (Syarat dan Ketentuan Umum) atau Syarat dan Ketentuan Toko Web, Ketentuan Indonesia yang akan berlaku sepanjang diperlukan untuk menyelesaikan konflik tersebut.
2. Penyedia Produk Digital
Anda memahami dan menyetujui bahwa Produk Digital dijual kepada Anda oleh PT Coda Indonesia, yang berkedudukan di Sampoerna Strategic Square, South Tower Level 19, Jalan Jend. Sudirman Kav. 45-46, Jakarta Selatan 12930, Indonesia (“Coda Indonesia”), dan bahwa Syarat dan Ketentuan ini disepakati antara Anda dan Coda Indonesia. Coda Indonesia dapat dihubungi oleh pengguna di Indonesia melalui SUPPORT PAGE.
3. Penggunaan Toko Web dan Pembelian Produk Digital oleh Individu di Bawah Usia 21
Penggunaan Toko Web dan pembelian Produk Digital di Toko Web tidak ditujukan kepada individu atau perseorangan di bawah usia dua puluh satu (21) tahun di Indonesia, yang belum menikah atau berada di bawah pengawasan (“anak di bawah umur”), dan tidak boleh digunakan oleh anak di bawah umur tanpa izin dan persetujuan orang tua atau wali yang sah. Anda dengan ini melepaskan setiap hak berdasarkan hukum yang berlaku untuk membatalkan atau mencabut semua persetujuan yang telah Anda berikan berdasarkan Syarat dan Ketentuan ini apabila Anda dianggap sebagai dewasa berdasarkan hukum yang berlaku.
4. Hukum yang Berlaku dan Penyelesaian Sengketa
Syarat dan Ketentuan ini akan diatur dan ditafsirkan sesuai dengan hukum negara Republik Indonesia terlepas pertentangan hukumnya. Kami akan berusaha untuk menyelesaikan secara damai segala sengketa yang timbul dari atau sehubungan dengan Syarat dan Ketentuan ini (termasuk segala pertanyaan mengenai keberadaannya, keabsahannya, atau pengakhirannya), tetapi jika upaya tersebut gagal, sengketa tersebut akan diselesaikan dan dirujuk ke Pengadilan Negeri Jakarta Selatan, dengan mengesampingkan semua pengadilan di tempat lain, kecuali untuk pengaduan yang diajukan oleh pengguna yang diklasifikasikan sebagai konsumen berdasarkan hukum, yang dapat mengajukan pengaduan tersebut ke pengadilan yang berwenang di wilayah hukum tempat tinggal pengguna.
